KX Institute – Course Terms & Conditions
KXPTI Pty Ltd ACN 688 308 965 (“KX Institute”, “we”, “us”, “our”) provides accredited Pilates education and certification programs. By enrolling in a Course, you (the “Learner”) acknowledge and agree that:

KX Institute may change, postpone, or cancel a Course, mentoring session or event due to enrolment numbers or other operational reasons. If this occurs, Learners will be offered:
KX Institute may update Course content, delivery methods, or assessments at its discretion.
Some Courses require the completion of designated practice teaching hours within the timeframe set for each Course, as follows:

Learners may choose to purchase a Studio Plus+ Package, which provides supervised practice teaching sessions at KX Institute–approved studios. Additional terms apply (see below).
Learners who do not purchase a Studio Plus+ Package must independently arrange their practice teaching hours.
If a Learner chooses to downgrade from a Studio Plus Package to a Basics Pack:
If a Learner decides not to complete the Studio Plus+ supervised sessions but wishes to remain in the Studio Plus+ tier, no refund is available unless the downgrade criteria above are met.
Assessments are evaluated by a certified KX Institute Education Team assessor against a predefined rubric and certification criteria. Learners will be notified of a pass or a fail within fourteen (14) business days.
If the Learner does not pass on their first attempt, they are entitled to one complimentary re-assessment. An Education Team member will provide detailed feedback and explain what requires correction or improvement.
Learners have thirty (30) days from the date feedback is provided to submit their re-assessment. Failure to submit within thirty (30) days results in the complimentary re-assessment being forfeited. Additional re-assessments may be purchased via the “Extras” section in the LearnWorlds Hub. All re-assessments must be completed within ninety (90) days of completing the assessment module, unless a Medical Exemption is approved.
If the Learner does not complete the required re-assessment within the allowed timeframe, they may be required to repeat all or part of the learning to remain eligible for the 20 CPD points. An Education Team member will provide advice based on the Learner’s individual circumstances.
Each Learner receives one complimentary re-submission if their initial assessment is unsuccessful. Re-submissions must be lodged within thirty (30) days of receiving feedback. All re-submissions (complimentary or purchased) must be completed within ninety (90) days of completing the assessment module. Additional re-submission attempts can be purchased through the Extras section in the LearnWorlds Hub. If a Learner does not pass after the maximum allowable re-submissions, or fails to meet the deadlines, they may be required to repeat some or all modules to be eligible for certification or CPD points. Medical Exemptions may be granted at KX Institute’s discretion when evidence is supplied.
The Dynamic Mat Course and Dynamic Reformer Course each include two (2) complimentary mentor sessions with a KX Institute–approved mentor. The Combined Dynamic Mat + Reformer Course includes four (4) complimentary mentor sessions.
Mentor sessions are learner-led and may include: discussion of theory or course content; guidance on session or class planning; observation of the Learner delivering a live online class; technique clarification or teaching methodology support; and personalised feedback and advice.
Additional mentor sessions can be purchased as an “Extra” through the LearnWorlds Hub and are subject to mentor availability.
Access to Course content will only be granted once the first payment (whether upfront or via instalments) has been successfully received by KX Institute. If the first payment fails or is reversed, Course access may be withheld or removed until payment is resolved.
Full payment of the Course Fee — including all instalments under an approved payment plan — must be received before any certificate of completion or CPD points are issued. Learners remain liable for the total Course Fee regardless of the level of Course engagement.
Payment for Courses must be made in Australian Dollars (AUD) via Stripe (credit card, debit card, and any other supported payment methods) or Afterpay (where available). Other payment methods are not accepted unless expressly approved in writing by KX Institute.
Payments via Stripe are securely processed by Stripe Payments Australia Pty Ltd. By completing a Course purchase, Learners authorise KX Institute to charge their nominated payment method for the full amount payable. Stripe may store, encrypt, and process payment details in accordance with its privacy and security policies. Learners are responsible for ensuring their payment method is up to date and has sufficient funds.
When Afterpay is selected, payment is made in instalments under Afterpay’s own terms and conditions. All approvals, instalment scheduling, late fees, or payment collection are managed solely by Afterpay. KX Institute does not control Afterpay approvals, declines, reversals, instalment schedules, or late fees. Learners are responsible for ensuring sufficient funds for each instalment. Any Afterpay late fees, penalties or charges are the responsibility of the Learner and are not refundable by KX Institute.
Learners are responsible for any bank charges (including international transaction fees), currency conversion fees, transaction fees, or late payment fees imposed by Afterpay or their financial institution. These charges are non-refundable by KX Institute.
KX Institute reserves the right to suspend or revoke Course access if payments fail, are declined, or become overdue, and to withhold certificates, verifications, or CPD points until payment is resolved. KX Institute may charge reasonable administrative fees for repeated payment failures. If a chargeback or dispute is initiated with a payment provider, Course access may be immediately terminated and the Learner remains liable for all Course Fees unless a refund is approved under the Refund Policy.
Continued non-payment may result in termination of enrolment without refund. If terminated for non-payment, reinstatement may only occur at the discretion of KX Institute and may require additional fees.
All Course fees include GST unless otherwise stated.
Learners are entitled to a forty-eight (48) hour cooling-off period from the time of purchasing the Course (the “Cooling Off Period”). If a refund is requested within this timeframe, KX Institute will process a full refund minus a reasonable administrative fee.
If a refund is requested after the Cooling Off Period expires, KX Institute may, in its absolute discretion, provide a partial refund in exceptional circumstances supported by evidence, such as a serious medical emergency, permanent disability, prolonged illness, or the death of an immediate family member.
Any bank or transaction fees incurred during payment or refund processing are the sole responsibility of the Learner. Refunds may take up to thirty (30) days to process following receipt of a refund request.
If a Learner purchased their Course via Afterpay, any approved refund will be processed in accordance with these Terms and Afterpay’s applicable terms and refund policies. Once KX Institute approves and processes a refund, Afterpay will adjust or cancel any remaining instalments and return any amount already paid in excess of what is owed to the original payment method, subject to Afterpay’s processes and timeframes. Any Afterpay fees, late fees, or charges applied by Afterpay are the responsibility of the Learner and are not refundable by KX Institute.
Courses are delivered predominantly via online modules. From time to time, KX Institute may make available additional face-to-face workshops, live online sessions, or hybrid delivery options. To access the Course and the Course Materials, Learners must:

By purchasing a Course, Learners agree that they will not:
Learners must notify [email protected] as soon as they become aware of any improper or unauthorised use or disclosure of any login information or Course Materials. Learners must only use the Course and Course Materials for their intended purpose.
All Courses and Course Materials are the property of KX Institute. Learners receive a limited, non-exclusive, non-transferable, revocable licence to use Course Materials solely for: (a) completing their enrolled Course; and (b) applying KX Institute methodologies appropriately in practice after certification. Learners must not: share, copy, record, or distribute Course Materials; upload materials to model-training or AI systems; develop derivative courses or training programs; or use KX trademarks without written permission. Any new intellectual property created during the Course belongs to KX Institute.
KX Institute may issue warnings, suspend access, or terminate enrolment for breaches of these Terms.
If a dispute arises under these Terms, the parties must comply with the following dispute resolution process: (a) the complainant will notify the respondent by giving a Dispute Notice specifying the nature of the dispute, the outcome required, and the action believed to settle the dispute; (b) the parties must in good faith attempt to resolve the dispute by mutual negotiation within fourteen (14) days (or such longer period as agreed); (c) if unresolved, either party may give a Mediation Notice to resolve the dispute via mediation; (d) within ten (10) days from the Mediation Notice, the parties may refer the dispute to a mutually agreed mediator, or request the Victorian Law Society to appoint an independent mediator; (e) the mediator will determine the time, place, procedures and rules for the mediation; (f) the mediation will be without prejudice and confidential; (g) costs of the mediation will be shared equally; and (h) a party will be deemed not to have attended the mediation unless represented by a person with sufficient authority to settle the dispute. No legal proceedings (except urgent equitable relief) may be commenced unless this process has first been followed and the dispute remains unresolved.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies which cannot be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including Schedule 2 – Australian Consumer Law. Where KX Institute is permitted to limit remedies for breaches of consumer guarantees, KX Institute’s liability is limited (at KX Institute’s election) to supplying the services again or covering the cost of having the services supplied again.
To the maximum extent permitted by law, KX Institute, its affiliates, trainers and licensors will not be liable for any indirect, incidental, special, punitive, exemplary, or consequential loss, including loss of profits, revenue, goodwill, or data, arising out of or in connection with the Course, the Course Materials, the Course platform and these Terms.
To the maximum extent permitted by law, KX Institute’s total aggregate liability for all claims arising out of, or in connection with, the Course, the Course Materials, the Course platform and these Terms (whether in contract, tort (including negligence), statute, equity or otherwise) is limited to the fees paid by the Learner to KX Institute for the Course.
Courses are provided on an “as is, as available” basis without warranties or representations of any kind, express or implied, including any implied warranties of uninterrupted availability. Live sessions, recordings and digital materials may vary in availability due to scheduling, maintenance, privacy safeguards, rights management, or technical constraints. KX Institute may update, modify, or withdraw content at any time.
KX Institute does not represent or warrant that: (a) the Course will be delivered uninterrupted, secure or error free; (b) any defects or errors in the Course will be corrected; (c) any content or information that a Learner obtains on or through the Course will be accurate; or (d) the server that stores and transmits the material is free of viruses or other harmful components. Any material downloaded or otherwise obtained through the Course is accessed at a Learner’s own discretion and risk. Completion of the Course does not guarantee employment, KX studio placement, client outcomes, earnings or business performance improvements. KX Institute is not liable for delay or failure to perform caused by events beyond its reasonable control, including, but not limited to, extreme weather, public health emergencies, network or utility outages, industrial action, acts of government, or third-party service failures.
Pilates training involves physical risk. Participation in some Courses may require reasonable physical fitness. Learners must consult a healthcare professional if they have medical conditions, are concerned about any aspect of their physical health, or they are pregnant. Learners acknowledge that there are inherent risks associated with physical training and participating in the practical training components of some Courses, and assume responsibility for their participation in all aspects of the Course. If a Learner experiences pain, dizziness, or discomfort, they should stop immediately and seek professional advice.
Learners are responsible for: (a) ensuring they are physically able to participate in the Course; (b) ensuring a safe environment for any physical activity required to be undertaken as part of the Course; (c) using equipment in accordance with manufacturer guidance and KX Institute instructions; (d) adhering to KX studio policies and location regulations; and (e) seeking appropriate supervision or clearance when required.
KX Institute collects and uses personal information in accordance with its Privacy Policy and may disclose information to partners and service providers as necessary. By enrolling in a Course with KX Institute, Learners acknowledge and agree that:

Learners must keep KX Institute’s Confidential Information private unless: (a) required by law; (b) already public through no fault of the Learner; or (c) required for legitimate purposes with confidentiality maintained.
These Terms are governed by the laws of Victoria, Australia.
Afterpay: Means the instalment-based payment service offered by Afterpay Australia Pty Ltd and governed by its own terms and conditions.
Assessment: Means the combination of requirements that must be submitted by the Learner for evaluation, including but not limited to: online theory components, completion of all online modules, submission of the Logbook, and the practice teaching video, as required by the KX Institute.
Assessment Module: Means the dedicated module within the Course platform where Learners upload assessment materials including video submissions and Logbooks.
Assessment Rubric: Means the predefined set of criteria used by the Education Team to evaluate whether a Learner has met the competency standards required for certification.
AUSactive Student Membership: Means the insurance-covered student membership issued by AUSactive, which may be required for participation in practice teaching activities.
Combined Dynamic Mat + Reformer Course: Means the KX Institute certification program that includes both the Dynamic Mat and Dynamic Reformer components.
Confidential Information: Means any confidential, sensitive, commercially valuable or proprietary information belonging to KX Institute, including Course Materials, Intellectual Property, assessment documents, Course content, processes, business operations, these Terms & Conditions, dispute information, and any other information that is stated to be, or would reasonably be understood as, confidential.
Course: Means any accredited training program offered by KX Institute, including the Dynamic Mat Course, Dynamic Reformer Course, and the Combined Dynamic Mat + Reformer Course.
Course Coordinator: Means the KX Institute representative responsible for managing Learner enquiries, deferrals, Course scheduling and administrative support, contactable at [email protected].
Course Fee: Means the total amount payable by the Learner to access and complete the Course, including any instalments or add-on charges.
Course Materials: Means all materials provided by KX Institute, including manuals, instructional content, videos, recordings, choreography, class plans, downloadable tools, templates, assessments, programming, branding assets, training methodologies, and any intellectual property forming part of the Course.
Education Team: Means the KX Institute staff and assessors responsible for delivery, evaluation, mentoring, and support of learners throughout the Course.
Extras: Means additional purchasable add-ons available through the LearnWorlds Hub, including additional mentoring sessions and paid re-assessments.
Intellectual Property (IP): Means all systems, programming, choreography, templates, designs, processes, business know-how, documents, training material, trademarks, logos, copyrights, video content, audio recordings, and digital assets owned or licensed by KX Institute and used in delivering the Course or Course Materials.
Intellectual Property Rights: Means all rights relating to patents, copyright, designs, trademarks, trade secrets, Confidential Information, database rights, know-how, and similar rights existing now or in the future under the laws of any jurisdiction.
KX Pilates: Means the franchised KX Pilates studio network operated separately from KX Institute, which may act as a practice teaching venue or approved partner for Learner activities.
Learner: Means a person enrolled in, accessing or participating in a Course offered by KX Institute.
LearnWorlds Hub: Means the online learning management system (LMS) used by KX Institute to deliver modules, materials, assessments, Extras and Course communications.
Logbook: Means the record-keeping document required for certification and CPD points, used to track observation hours, practice teaching hours and self-practice, completed digitally or in printed format, and submitted as part of the final assessment.
Medical Exemption: Means written approval provided by KX Institute to grant additional time or accommodations due to injury, illness or medical circumstances supported by evidence.
Mentor Session: Means a forty-five (45) minute, learner-led online session with a KX Institute–approved mentor, included in Course enrolments or purchasable as an Extra, used for theory support, teaching guidance, observation, feedback or personalised learning.
Practice Teaching Hours: Means the required number of practical teaching hours that must be completed by Learners within the timeframe of their Course, recorded in the Logbook and submitted for assessment.
Practice Teaching Video: Means the video evidence of a Learner teaching a class or session, submitted as part of the Assessment Module.
Privacy and Data Policy: Means the KX Institute policy governing the collection, use, storage and disclosure of Learner personal information and data.
Studio Plus+ Package: Means an optional package providing supervised practice teaching sessions at KX Institute–approved studios, subject to separate terms.
Third-Party Partners: Means vendors, systems, platforms, mentors, KX Pilates studio partners and other authorised organisations that support Course delivery and who may receive Learner data as outlined in the Privacy Policy.
KX Institute – Studio Plus+ Packages (Supplementary Terms)
Studio Plus+ Packages provide supervised practice teaching sessions at a KX Institute–approved location: twelve (12) sessions for the Dynamic Reformer or Dynamic Mat Course; and twenty-four (24) sessions for the Combined Dynamic Mat + Reformer Course. All Studio Plus+ practice teaching sessions are supervised by a KX Institute–approved mentor.
Studio Plus+ practice teaching sessions are not transferable to another person and hold no monetary value; they cannot be sold, exchanged, or redeemed for cash.
Sessions must be used within the duration of the relevant course period: nine (9) months for the Dynamic Reformer or Dynamic Mat Course; and twelve (12) months for the Combined Dynamic Mat + Reformer Course. Any unused sessions after the course period ends will be forfeited.
If you are unable to complete your sessions due to a medical condition, you may apply for a medical exemption by emailing [email protected]. If approved, KX Institute may offer a credit voucher for the value of the unused sessions, minus a AUD $250 administration fee. Credit vouchers are issued at KX Institute’s discretion and may be subject to additional conditions.
